Defined as “the practice of ordering medical tests, procedures, or consultations which are not medically indicated or refusing the treatment of certain patients in order to protect the responsible physician from malpractice challenges”, defensive medicine is complex problem, including judicial and economic factors. We confirm European doctors’ to evidence-based care and every patient’s right to receive care appropriate to that patient’s health needs. In our position paper, we sets out a series of recommendations both to professionals and to policy-makers in an attempt to identify some of the common aggravating or mitigating circumstances of defensive medicine. CPME will continue to support its members in further discussions on this topic.
